Terms & Conditions of Hire
The Company: Popular Plants Limited T/A Top Topiary
The Customer: The person or company who is hiring the Goods.
The Goods: The plants, trees or topiary hired from the Company to the Customer.
Hire of Goods
The period of hire shall commence from the time and date when the Goods are delivered and shall terminate when the Goods is returned to the Company’s premises.
The Goods shall remain the property of the Company and are provided to the Customer solely on a hire basis.
The Goods may only be used for the agreed purpose at the agreed location and should be kept on the premises.
The Goods may only be kept for the agreed amount of time unless written permission is received from the Company.
When the goods are with the Customer it is the responsibility of the Customer to looked after and care for the Goods in accordance with instructions provided by the Company.
The Goods must be returned in the same condition as they were received in.
If damage or loss occurs the Customer must pay the repair costs or replacement value of the Goods.
Full payment will be taken upfront for the full hire period unless otherwise notified by the Company.
Deliver and collection will be arranged by the Company unless agreed otherwise.
In addition to hire charges the company may make a separate charge for outward delivery and collection. The Company’s packaging materials are chargeable in full if not returned upon completion of the hire.
Defects and Liability
The Customer shall notify the Company of any defects in the Goods within twenty-four hours of receipt of the Goods. Failing such notification, it shall be conclusively presumed that the Goods have been received in good condition and in every way satisfactory for the Customer’s purposes.
In no circumstances shall the Company’s liability to the Customer exceed the invoice value of the contract.
The Agreement is governed by the laws of England. Any dispute may be submitted to the non-exclusive jurisdiction of the English courts. If any provision of this Agreement is or becomes invalid or unenforceable the remaining provisions shall not be affected.
